Trade Secrets Theft: Need for Transatlantic Cooperation (WDC)
July 11, 2013

The theft of trade secrets continues to be a challenge deeply relevant to both US and European companies, particularly when operating in third countries. Close transatlantic cooperation is needed to foster effective policy responses. Currently trade secrets laws vary largely across EU members state borders, thus increasing the complexity of potential litigation. In 2012 the EU Commission launched an initiative on the protection of trade secrets and is considering a potential Directive on the issue. This initiative and the launch of the negotiations for a Transatlantic Trade and Investment Partnership (T-TIP) provide an opportunity to encourage closer dialogue between the EU and the U.S. to develop policy options that mitigate the impact of trade secrets theft.
